The former President of United States of America, Joe Biden, had signed amendment in law, i.e. Social Security Fairness Act, regarding the payment of due benefits for the federal employees. This new law now provisions payment of all the pension benefits to be recalculated and paid to eligible federal employees. The Windfall Elimination Provision and Government Pension Offset are being repealed by the amendment. This amendment was implemented in January 2025 and will effectively enable payment of due from January 2024. The federal employees who have not received benefits that were not covered under the Social Security programs will receive their respective Social Security Fairness Act benefits. These benefits will be given to former employees including teachers, fire-fighters and police-officers who are now receiving their pension benefits under the Social Security.

In compliance with the Social Security Fairness Act, the Social Security Administration had already begun distributing the pending benefits of the federal employees. This step will benefit approximately 2.5 million citizens in the USA. The previous WEP and GPO laws prevented the payment of any benefits other than the ones that were covered under Social Security. Now the Social Security Fairness Act remedies that and all the pending payment since January 2024 will be paid to all eligible federal employees. Earlier, the limited payment of Social Security benefits had adversely impacted a huge chunk of the federal workforce. It is a very welcoming decision in my opinion but at the same time the ones that haven’t yet received their pending benefits need to inform the relevant authorities so that their dues can be cleared.

As of now, it is estimated that at least 91% of the payments have already been distributed under the Social Security Fairness Act. It is very crucial to provide all necessary documentation as required by the Social Security Administration as all the remaining federal employees will have to be processed manually. It is estimated that benefits of around 200,000 federal employees still remain to be recalculated and processed. The automated processing of the payments under the Social Security Fairness Act began in February 2025 and the majority of the payments were processed by March 2025. The incremented monthly benefits were processed and distributed from April 2025 which also included increments of the previous month. The federal employees who haven’t yet received will be processed manually and therefore may take up to November 2025 for all these discrepancies to be removed.
